Not available - it’s an administrative hearing. But “at your peril” is exactly right: if one side chooses not to present evidence to support its case, the judge will make his ruling on the basis of the facts before him, which means that the other party will prevail.

Bad decision by the attorney.

Not only will the plaintiffs prevail, Obama will be barred from submitting any new evidence during an appeal.
