just because a lawyer voluntarily surrenders, without a deal for SOMETHING, does not stop an investigation.

This is done to put a suspension in place if the lawyer ever decides to return. Thus a five year suspension would have to be served FIRST THEN he could practice AFTER returning.

Most likely in 2008 there was no investigation of substance and he just did it to avoid the clintonian suspension.
