HIPAA imposes, or rather allows the Secretary of HHS to impose, regulations covering record keeping.
As you might imagine, they are extensive, and difficult to comply with in their entirety.
The government prosecutes breeches very aggressively.
So, in the event of a high-profile breech (as this one would certainly be), let's say that the former employee's computer access was not terminated the minute she was terminated. Or let's say that the office policy manual was not paginated correctly.
In either event, according to HHS, yes, it would be the doctor's fault.
Yes, she's a real doctor. She is indeed a doctor at Mount Kisco Medical Group – one doctor among very many doctors. I'm just saying that I'm familiar with the group, as I raised my kids using them, and there WAS NO SUCH THING as a “Department of Medicine” there. There are specialty groups, but the whole place is a "Department of Medicine." So her title of "Chairman" of a non-existent "Department" is a major red flag.
The "symptoms" listed just HAPPEN to track precisely with all the internet gossip out there.
Do you really believe Hillary Clinton, notoriously paranoid, would tell a local non-biggie doctor, "Oh yeah I have frequent blackouts" and all these other confessions of ineptitude and incapacity?

Also: no specific medications are listed, just general categories ("her medication for seizures"). Not a single doctor would ever do that. The specific medication would be named.
So if another employee illegally accessed the files and printed copies it would be the doctor’s fault?
Legally, yes, for not having adequate protection—you are deemed negligent. Remember, this is an Obama world; federal laws now generally have strict liability.

IF they are authentic, the leaker could have easily printed them out and took photos, for future use.
Wesearchr.com is offering @hillsmedrecords bounty $ if she needs a bodyguard. She said there was more to come but either hasn’t posted or Twitter has locked her out.

But she is not "Chairman of the Department of Medicine, Mount Kisco Medical Group" because there is no such thing. "Chair of Internal Medicine" with the MKMG letterhead is legit, and a completely different thing.
The supposed medical records are a hoax.
We shall see. Maybe you’re right. Maybe not.
