He is free to press charges.
However, when she goes to trial, he would have to take the stand and things may get awkward for him when he has to explain his history.

When I was on a jury we weren’t allowed to know the history of witnesses or the accused.
The only thing we were allowed to know was testimony and evidence about what happened at the scene of the crime.
