It’s a Constitutional 4th Amendment Due Process Life, Liberty, or Property depravation issue.

Because all death penalty cases can and usually are appealed all the way to the supreme court

Due process. The SC reviews the case to see if any errors were made in the trial or appeals process. They don’t judge the facts of the case.
