Once you get the decision you want you ignore the RAT judges , continue on with what the Judge you picked wanted , and then have the Supreme court decide the final issue.
Thomas Jefferson was worried about this final decision capacity the court siezed with Marbury v. Madison. That alone would be a good reason for invoking Article V to put an end to this black robed tyranny.
