Question about the "FBI Process Crimes" - Hypothetical

Okay a question about the "process crime" that Flynn is accused of.

Say for instance I am on the phone and the conversation between me and my friend is being recorded by the FBI/NSA/etc...

My friend asks: "How many beers you got in the fridge?"

I answer: "I have 4 beers in the fridge"

Now as I answer this I base this information on the fact that last time I checked the fridge I saw 4 beers on the shelf and I didn't notice two old cars of PBR waaay in the back that I only use for Chili cooking ONLY. After I get off the phone a little later I go to the store I buy a six pack as I know my friend is coming over and they drink at least 4 beers and I want to drink a few myself.

Now, a day later the FBI comes to your door and they take you in for questioning and they ask you: "How much beer is in your refrigerator?"

What is the Answer that will prevent you from being arrested for a "process crime"?

Answer: YOU ARE SCREWED, THERE IS NO CORRECT ANSWER EVER!

Why is this? Well let's walk through the possible answers.

( You decide to answer how much beer you think you have ) You answer 10 beers, however they have you ON TAPE saying 4 beers: GUILTY OF LYING TO THE F.B.I.

( You decide to answer based on your call to your friend because he is involved in shady things ) You answer 4 beers, however they have a receipt from your pocket that says you bought a six pack: GUILTY OF LYING TO THE F.B.I.

( You become beer-niscient and answer based off your new powes of counting beer in the fridge ) You answer 12 beers, however they have you ON TAPE saying 4 beers: GUILTY OF LYING TO THE F.B.I.

( You decide to refuse to answer the gestapo FBI agent ) .... You are obstructing a federal investigation: GUILTY OF OBSTRUCTING THE F.B.I

( You forget how many beer you have since you drank vodka last night ) You say you don't remember how much beer you have in the fridge, however they have you ON TAPE saying 4 beers: GUILTY OF LYING TO THE F.B.I.

And that is just some of the scenarios, the point is the FBI is ABOVE THE LAW AND ACTUAL DUE PROCESS.

Process Crimes are an absolute abomination to the spirit of the law. PERIOD.

What do you think?

The correct answer is, don’t ever talk to law enforcement when your ass is on the line ever.

Seems to me there would have to be a sworn statement in order to be accountable. Other than that you analysis pretty much says it all. You're screwed if they want it to end that way.

The comment from the judge on potential sentencing reinforces that. Screw as many others as you can to save your butt.

While there is truth here, I think the better comparison is if they asked you the next day whether you talked about beer on the phone with your friend and you replied ‘no’.

There is only one safe answer: “Please submit your questions to my attorney, and we will get back to you. Please include with your questions your explanation as to why I under any obligation to answer”.

Simply refusing to answer is a good tactic.

One almost as good is say, Here, let me turn on my recorder, so that there is no question about what was said during this conversation.

The FBI refuses to conduct interviews that are recorded. So, they would likely leave you alone.

Another good tactic is to say - I do not recall, I do not remember, I do not know. The Clintons are famous for that one.

While your point that process crimes (and the FBI) are abominations is correct, the fact is that you can only be charged with, and convicted of, a process crime IF you TALK to the authorities.

Do not talk to any authorities without your lawyer present, and even then just say "I don't remember".

If you are an innocent non-criminal, you should ESPECIALLY not talk to the police. You have no “bigger fish” criminal friends to snitch on as part of a plea bargain, so you have no leverage.

A friend of mine got busted for drug possession in his younger days. They offered him a plea bargain: plead guilty in exchange for probation with no jail time. He took the plea. Later he discovers that he’s now in the convicted felon database, and he can forget about ever being employed in a professional capacity at any corporation.

I think it would be more like “Did you talk to your friend on Tuesday Dec 15 2016 at 3:01 PM about the subject of beer? Did your friend ask how many beers were in your refrigerator? Did you tell your friend how many beers you had in your refrigerator?”

Universal answer:

“Please direct any questions to my attorney, Mr.Ms XXXX, his/her telephone number is. Also, please refrain from asking me any further questions. Unless I am under arrest, I will politely be leaving now.”

If they ask if you know what is is they want to ask you about:

“Please direct any questions to my attorney, Mr.Ms XXXX, his/her telephone number is. Also, please refrain from asking me any further questions. Unless I am under arrest, I will politely be leaving now.”

If they say they only have a few easy questions so they can wrap this up;

“Please direct any questions to my attorney, Mr.Ms XXXX, his/her telephone number is. Also, please refrain from asking me any further questions. Unless I am under arrest, I will politely be leaving now.”

If they ask you if it is Tuesday, if you are wearing a blue shirt, of if you know somewhere they can get a good sandwich for lunch,

I agree completely.

Ayn Rand figured this out long ago: A superfluous multiplicity of laws guarantees that all citizens are de facto lawbreakers, and allows for political persecution via selective enforcement.

This is why I, an ordained minister who has led one of the most boringly upright of lives, do not trust the police, and want as little as possible to do with them.

The FIB are much worse.

Your reply is: After my lawyer arrives we will be taping the interview for our records. If you have any wiretap information you must disclose it before we begin the interview and provide copies of the warrants for the wiretaps.
