Yeah. The 187 angle is missing any sort of useful crumbs here. But the vacancy, let's presume based on natural death, could still be used as a carrot during the tarmac meeting.
Not advanced planning. Exactly one month after Scalia was snuffed, Obama nominated Merrick Garland to fill Scalia’s seat. The Senate held off as it was an election year and it was unseemly to confirm such an important appointment at the time. Obama was set to recess Garland on January 3, 2017 which would have seen Garland serve for one year thereby ‘resisting’ Trump’s dismantling of the Obama legacy. But the Senate held itself in ‘pro forma’ to block Obama.
With the Senate stalling the Garland confirmation, the stage was set for Lynch to be informed as thus:
“Those right-wing republicans have obstructed Obama for 8 years. They couldn’t stop him so now they’re trying to stop Hillary. They can’t be allowed to take down Hillary on this matter. There’s the Supreme Court, Hillary, I, the whole party, a hundred million Americans and our friends in Europe and around the world, are wanting you to stay on where you’re at to help stop the right wing from doing terrible damage to all of us. (People are also talking about the first black woman Justice and Hillary wants you to consider accepting that). This so-called investigation is a cockamamie right-wing hit job when it’s really just a matter of personal and private communications. Let JC make his announcement and let’s all follow his lead to settle this matter. We need your word on that. And don’t let the right-wing keep spinning this as an investigation. It’s all political, it’s a personal matter that they are politicizing to use against us so they can stop us from advancing the Supreme Court for the next generation.”
Let’s see if Scalia was killed,gone,Roberts compromised,how would that effect the balance of the supreme court on big issues?Of course if hillary loses all bets are off.
