When the person in the photo is a white man, the software is right 99 percent of the time.
But the darker the skin, the more errors arise The machines are learning what we already know. They all look alike... /S

Is this the same soft ware that thinks all oriental men look the same? No, I believe you're referring to the new iPhone X, with a face contour mapping scanner. The story I remember was two Chinese women. They found the phone would let either one of them use it after only the owner had scanned herself in to the facial recognition system.

It’s a good thing that most criminals are white guys, otherwise, this would be a total waste.

Shadows are the same color regardless of race. Mapping shadows distinguishes the contours and shapes. The differences in contrast do make it more difficult to distinguish the contours when the highlights are closer in value to the lowlights. It’s a matter of the physics of light.
