Is there any evidence in this case?

I may have a bias, because a few years ago, I was on a jury which was considering a case of sexual assault.

The charge was that a man touched a woman’s breasts twice.

We the jury found the defendant not guilty of sexual assault charges. And our key reasoning was that there was no real evidence, it was he said/she said. We the jury reasoned that there was no way to know if he really did this. There was no physical injury reported, no evidence that the actions ever happened.

It was an unusual set of circumstances. Her car had broken down on the side of the road, and his car had a flat tire, so both were pulled over right behind one another on a road. She asked to use his cell phone. During this use of the phone, he allegedly touched her on the breasts.

Of course I think rape and sexual assault are very serious crimes. But in this case, there was just no evidence in the opinion of the jury.

I question how it is, that all of a sudden, cases from years ago are being reported and prosecuted.

With this whole Me Too movement, we still need to have due process, and everything has to be considered on a case by case basis.

I agree but, seems the liberal judges of today think otherwise. Without ANY proof, IMO cases like this should be tossed.
