Well, if you go past the clickbait headline on FR from a blog pimp that doesn’t even bother to put up a brief summary, you’ll see it is a civil action, not a criminal prosecution. And since it’s being set up as class action, you have to wonder if the corporations are colluding with the plaintiff’s counsel to use this to insulate them from future lawsuits.
(As class action rules have been tightened, corporations have found them to be a useful tool. Plaintiff’s attorney will get a few million, class reps may get a few thousand, and everyone else may get a couple of discount tickets to Disneyland and some movie passes. And if victims don’t opt out, they can’t bring their own lawsuits later).

I put that in all-caps so that, hopefully, others will notice. A criminal RICO complaint - filed by the government - is serious business indeed.
But a civil RICO action is much less of a big deal. Anyone can do it. I just happened to stub my toe on a park bench yesterday. I could file a civil RICO action against the city and the makers of the bench, as they might have conspired to allow unsafe benches to be installed there.
