The remedy for Trump being unhinged is impeach or don’t re-elect.
Imputing bias from the bench of the Supreme Court is not the appropriate remedy. In fact, from her argument, it is clear she would only apply her remedy, of inspecting prior speech and imputing motives, to someone like Trump, not someone like Obama.
Similar reasoning was used by Judges in Hawaii and in several other districts (Ninth and Second, IIRC). That reasoning is in itself unConstitutional, because it bypasses the Constitutional remedies.
