Haven’t they hinted that they won’t confirm a replacement nominee? That would make Rosenstein the Acting AG.

If Ted Cruz loses in November (which he won’t), he’d be a great pick.

Cruz has made too many enemies on both sides of the fence.
He would never be approved by the Senate.
There are better picks out there that are not Senators.

The Vacancies Act of 1998 means the President isn’t stuck with the next in line. The President can interim appoint anyone the Senate OK’d for a different job.
