Massachusetts woman accused of raping toddler released without bail

PITTSFIELD, Massachusetts (NEWS10) - A Pittsfield woman was arraigned Monday afternoon after being charged with raping an 18-month-old boy. Following her arraignment, she was released on the condition of not having any contact with the alleged victim.

The incident allegedly happened back in January, and now a 29-year-old mother is facing some serious charges in Berkshire County.

Erica Emerling has been charged with aggravated rape of a child with force, posing a child in a sexual act, and aggravated indecent assault and battery on a child under 14. No one related to the case would speak with NEWS10 ABC, but retired Troy Police Captain John Cooney says the charges are heinous.

“What really ramps this up is not that the first charge is bad as it sounds. Now with it being an aggravated charge that means basically that the child was injured based on the actions of the defendant, just horrible,” he said.

Digging deeper into the case, NEWS10 found what was thought to be Emerling’s address. NEWS10 knocked on the door to speak with her but was told she moved months ago.

The District Attorney says they, too, did not have her current address.

Emerling is expected to appear in court again next year on February 6th.

WTF. They don’t even have a current address for this perp and they released her without bail? And what happens when she doesn’t show up for her court date?

* * A number of Policemen have been murdered (by illegals) and one War Vet getting killed by an Illegal DWI.
* The people of MA are getting sick of all of this.
* The question begs will they make a dent in this lunacy this fall and elect some "R's" / conservatives.

As in Geoff Deihl who is running for Senate against Liz Warren and hopefully he wins the primary on the 4th.

I don’t know how a woman rapes an 18-month-old. I mean, she doesn’t have the equipment.

I guess it doesn’t matter. It seems she did something awful to a child.

Sexual assault is sexual assault, even more if the assaulted is a minor, far more if it is an infant...

Death Penalty if found guilty. PERIOD!

This kind of ruling, according to reasonable speculation, strongly suggests the judge is involved in similar acts behind closed doors.

The article doesn’t identify the women as the child’s mother, only that a mother now faces serious charges which seems like a circular way of saying she is the mother without identifying the child.

Releasing a parent without bail while facing really serious charges almost seems intended to encourage them to abscond and abandoned the child to the state. Seems like it might expedited the child adoption availability.

In California, the Governor just signed a bill eliminating monetary bail entirely. This goes under the category of “what could go wrong?”....

I know what you mean.

This morning my wife and I had breakfast with a long time friend and his wife. When we came out of the restaurant he pulled me aside and asked me if I remembered so and so, I said I did, he told me so and so was just sentenced to 3years in prison for sexual assault on a 12 year old girl.
So and so has to be in his 70s and a very pleasant and helpful person. You never know do you? - Tom
