A first offender deal includes deferred prosecution, anotherwords if the first offender ever commits another crime this one could be re-prosecuted. In this case his case was forever dismissed and permanently sealed.
A first offender deal certainly wouldn’t include the offender immediately going out and stating he is innocent and falsely prosecuted.
A first offender deal would include community service served specifically for that offense, not some vague “he is already active in the community”.
There is no category for this other than a gross perversion of justice. Calling it an application of a program which actually makes some sense is misleading.
Real first offender situations involve conditions such as future law obedience, reimbursement to victims, related community service, and probation. Upon completion of those conditions the charges would be dismissed and expunged (which doesn’t mean eternally sealed btw).
In this case Smollett was let off Scot free except for forfeiture of $10k upfront bail.
This is f’d up. Smollett could have started riots that may have killed a lot of blacks.
How the hell does that help his “cause”?

In all seriousness, it does sound like a first-offender/second-chance deal to me. Smollett forfeited his bond. And he evidently did some kind of “community service”. Why would the DA mention all that if Smollett wasn’t in some kind of program?
Now, this Smollett deal might not fit the mold of other deals across the nation. But remember, this is Chicago. Anything goes.

This poor innocent man (I hope that’s not biased). Let me reword that. This poor innocent human being has been slandered. He must have his attorneys take the Chicago police to court. He is a first offender except for his previous case of providing false information. His record is sealed and has been wiped clean. It would be interesting to find out how he arranged this.
