Rush, of course, is referring to the “fruit of the poisonous tree.” I’m not a lawyer, but its not uncommon for charges to be dropped, or verdicts overruled, when illegal means were used to gather evidence that led to them.
Some of the people investigated have been referred to federal district courts, and maybe state courts, for further investigation and prosecution. My question is, can the states’ courts charges and verdicts be overridden if they were turned over to them by federal courts, ie, does the “fruit of the poisonous tree” taint go along with those referrals?
