It remains unclear if they were trying to break into the property, or what their motive for being there was. It never ceases to amaze me how the same media that can’t hazard an educated evaluation of what these two perps were up to or figure the motive of someone yelling Alahu Akbar while stabbing multiple innocents but can positively see racism in everything President Trump says or does.

I'm sure not all will agree, but whoever the homeowner was, he was way out of line. From the article, from the father of one of the 17 year-olds:

Javier's father Jimmy said he should not have fired his weapon because the teens were in his garage and not his house.

'It wasn’t in your house, it was in your garage.

'That’s like 10 feet away from your house, you know so that means you’re seeing some perps out there at your garage, you know, so my first instinct is to call the police,' he said.

This father is correct. Killing someone who is in your garage (unattached from the house no less), and who isn't directly endangering your life, is not justified.

Maybe they attacked the homeowner when he caught them in the garage? Not much info in the story. The police are still interviewing the home owner.

Almost anything he says at this point will be bad for him. He should just let his lawyer do the talking.

Doesn’t Texas have a law that justifies that? I would’t think Ohio would.

I remember being a 17 year-old boy. Even at that age, I assumed it was common knowledge that going onto someone's property, especially entering a building, at night uninvited would get you shot and probably killed. <shrug>

It looks like abandoned property. The house is boarded up. The homeowner did not say they were threatening his safety. Seems like this is shoot first and ask questions later. As a teenager I occasionally found myself snooping around abandoned property. This is a terrible price to pay for curiosity.

castle doctrine...you don’t wait to see if your life is threatened in your own home...no charges.

To charge them the prosecution would have to show that the shooter did not use deadly in self-defense, defense of his residence, or to protect the life or safety of another. They may be able to show that in this case.

How does the homeowner know that the intruders aren’t setting an explosive device or going to come out of there with AK47’s and storm into the house? They’re trespassing and they’re not in view in a city (Dayton) that’s on edge.

They were collecting materials for a recycling drive at school, no doubt.

I'll leave open the possibility that the homeowner set them up, telling them to go ahead and collect up those cans at their convenience, no need to knock.

Only partially joking. I mention it because news reports are never to be trusted at face value. I try not to forget that by thinking up scenarios that could flip a story completely around, just in case.
