Aaron Carter's arsenal isn't going to be taken from him ... at least not yet, but that could change if authorities decide he's mentally unfit to own firearms.
Carter has been erratic lately ... friends and family have been so worried they've called police to do welfare checks.
Law enforcement sources tell TMZ ... until a court, board, commission, judge or other lawful authority determines Aaron suffers from a mental illness or condition that causes him to be a danger to himself or others, he can keep his guns.
If this were to happen, we're told Carter would possibly be asked to voluntarily hand over his weapons first, but then if he failed to comply ... ATF could seize his collection.
That said, the L.A. County Sheriff's Dept. tells TMZ the Dept. is investigating the entire matter and dealing with Aaron's family members who have expressed concern and even alarm.
Aaron spoke with TMZ Monday, telling us cops responded to a call Sunday night and showed up at his home with the intent of taking him away on a 5150 psychiatric hold.
The singer says he warned deputies he had loaded weapons scattered around his home, but he also convinced them and a mental evaluator he was not a danger to himself or others.
He also claims he doesn't know who sent the authorities to his house, but one thing he's clear about -- he's not going to give up his guns because he says he fears for his safety.
Aaron's been adamant with us recently that he's mentally stable, despite going on "The Doctors" and rattling off that he's been diagnosed with bipolar disorder and schizophrenia. When he spoke to us Monday, he refuted that and claimed he's passed all the mental health checks to own a gun.
So, for now ... he remains locked and loaded.

Yeah, that won’t be hard for some judge to declare because, well, because he/she is a judge by golly.
If you own a gun you’ll be automatically deemed mentally unstable.
Isn’t just the desire to own bad tubes that push out bullets, in and of itself, a mental illness?

And herein lies the problem with red flag laws- people that don’t know any better, or worse- have something against him- report him- claim he is unstable- The courts must act in their own opinions- and the only judgement they can make in their own opinions is that yes, he’s unstable- because if they say he isn’t, and he eventually does hurt himself or others- huge lawsuits await- and people’s jobs will be on the line- noone will dare claim he isn’t a danger because by golly some people said something-
We are moving into the territory of ‘thought crimes’ - people being arrested for future possibilities- and deemed ‘too dangerous to own guns’

Whomever called should have to go through the same psychological evaluation that he has to.
I looked him up and found his Twitter account. Don’t know him but am familiar with Back Street Boys.
That said, this kid is replying to every tweet very defensively and sounds manic, tightly wound.
The entertainment industry is going to claim another life if he can’t throw his phone away and get out of the spotlight.

Article said LA Sheriff Dept would hand off collection to ATF. As far as I can figure there is no federal statute being violated. Why ATF, unless the Sheriff is leary of sending his deputies to do the deed.
If the left gets its way,this will snare millions.
I’m kind of curious to know what is in his “arsenal”. It is 4 guns and a few hundred rounds of ammo? Or, like a real arsenal, given that so much stuff is illegal in that state.
I suspect he has a drug problem. Unclear whether the claims of bipolar and schizophrenia were him to trying to excuse his behavior or for PR....versus really having those mental disorders.
Britney Spears is the most famous case going on right now. Had they not intervened she would probably be broke or dead.
