President Donald J. Trump Announces Judicial Nominee

Today, President Donald J. Trump announced his intent to nominate:

James Patrick Arguelles, of California, to serve as a Judge on the United States District Court for the Eastern District of California.

James Patrick Arguelles currently serves as a Superior Court Judge in Sacramento County, California.  Before taking the bench in 2010, Judge Arguelles was a Partner at Stevens, O’Connell & Jacobs, LLP, an Assistant United States Attorney for the Eastern District of California, and in private practice at Gibson, Dunn & Crutcher, LLP.  Judge Arguelles is also a Military Judge in the United States Army Reserve.  Upon graduation from law school, Judge Arguelles served as a law clerk to Judge Marilyn L. Huff of the United States District Court for the Southern District of California.  Judge Arguelles earned his B.S., as a Distinguished Graduate, from the United States Naval Academy, his M.S.S., as a Distinguished Graduate, from the United States Army War College, and his J.D., magna cum laude, from Harvard Law School.

It will take VP Pence to break the tie that is sure to come when Myth and Murkowski vote against all future Trump nominees, with the possibility of the Maine-iac joining them.

This is a District Court, not Appeals Court. Judge Arguelles’ rulings will be appealed to the Ninth, where they will likely be over ruled. We need a few more seats there before we can have reasonable decisions in the west.

The Ninth Circuit has already handed President Trump a number of victories including asylum policy, withholding money from sanctuary cities and not funding organizations that promote abortion.

We get a few victories here and there. The 9th is still majority leftists, but they hear cases in 3 Judge panels. Some of those panels will have 2 moderate or conservative judges, and that’s where the reasonable decisions come from. When a case is important enough that the 9th isn’t willing to accept the decision of the panel, they re-hear the case “En Banc”, and overturn the panel. I’ve seen this happen in all of our 2A cases. If Trump get’s another term, we will flip the 9th.

It’s a little frustrating wanting quality but also quantity and quickly. But slow and steady wins the race.
