Chief District Judge Jane Magnus-Stinson ruled Friday in Indiana that the execution would be delayed because of concerns from the victims family about the coronavirus pandemic.
The Justice Department (DOJ) argued that the judges order misconstrued the law and asked the appeals court to immediately overturn the ruling.
The appeals court found that the claim from the victims family lacks any arguable legal basis and is therefore frivolous."
The Justice Department also argued that while the Bureau of Prisons (BOP) has taken measures to accommodate the family and implemented additional safety protocols because of the pandemic, the familys concerns do not outweigh the public interest in finally carrying out the lawfully imposed sentence in this case.
The appeal came after a BOP staff member involved in preparing for the execution tested positive for the coronavirus. However, the Justice Department said the development would not mean an additional delay in the governments timetable because the worker had not been in the execution chamber and had not come into contact with anyone on the specialized team sent to the prison to handle the execution.

Should note, this is the victims family not the perpetrators family. They apparently dont want him executed but want to be there to witness his execution. This is just a ploy by people who oppose capital punishment.

As soon as the appeals board said the execution can proceed, the executioner should’ve walked straight to this guy’s cell and put a bullet in his head.

who cares what the victims’ family members think? This was “the people” vs Daniel Lee. “The people” demand he pay for his crimes with his life. The wussy family members need to STFU.
Libs seem to be up in arms even though he was one of those “white supremacists” they always talk about.
A perfect example is the three white supermacists in Texas tied the black guy to the back of their pickup truck and dragged him to death. Liberals exploited the incident and quickly attacked GWB for it, saying Texas' "hate crime" laws weren't strong enough. Then AFTER one of those dirtbags was RIGHTFULLY sentenced to death for his crimes, and they balked and said the death penalty is TOO harsh!
