Federal police are again patrolling the streets of Portland. But this time, they're also Portland cops.

Last week, U.S. Marshal for Oregon Russ Burger deputized about 50 Portland police officers as deputy U.S. marshals. That deputization lasts the remainder of the calendar year, as Oregon Public Broadcasting first reported this week.

That revelation set off a flurry of finger-pointing and a jurisdictional standoff. Mayor Ted Wheeler wants the deputization rescinded, saying it represents an incursion by the federal government into local law enforcement. U.S. Attorney for Oregon Billy Williams refused, saying Portland protesters weren't facing harsh enough consequences under Wheeler's watch. And Gov. Kate Brown, who set the whole thing in motion? She claimed ignorance of the details.

So Portland has four dozen newly minted Raylan Givenses. What does that mean for Black Lives Matter protesters and others who plan to march in the streets?

Inasmuch as I was once (long ago) “double sworn” as both a State peace officer & a Special Deputy US Marshal, let me answer that question:

The Special Deputation means that the “double-sworn” Portland officers can enforce BOTH Oregon & US federal laws.
It also means that the US Attorney will PROSECUTE violators, rather than the local District Attorney, IF there is any violation of federal criminal statutes.
AND
Tthe violators will be indicted/tried/sentenced in the US District Court.
(Trials in a US District Court have an over 90% rate of conviction AND the sentences levied upon conviction are generally FAR more harsh, than the sentence is in State/local courts.)

BAD NEWS for the RIOTERS, ARSONISTS, LOOTERS (& anyone else, who has a FEDERAL WARRANT out for their arrest): You will be indicted/tried in the US District Court & facing a US District Judge, who won’t care what the Portland Mayor wants..

More to the point, The US District Court OFTEN prosecutes people who conspired to violate federal laws under the RICO ACT, with a MINIMUM sentence of TEN YEARS & NO PAROLE.
