A federal appeals court has slammed the brakes on the city’s mandate that all teachers and other school workers be vaccinated by Monday - but a reprieve for the holdouts may be short-lived.
On Friday evening, the US Court of Appeals for the Second Circuit granted a temporary injunction against the mandate, and sent the case to a three-judge panel for an “expedited review.” A hearing is scheduled for Wednesday.
“We’re confident our vaccine mandate will continue to be upheld once all the facts have been presented, because that is the level of protection our students and staff deserve,” said Danielle Filson, a spokeswoman for the city Department of Education.
Schools Chancellor Meisha Ross Porter sent an email to DOE staff Saturday morning saying “we should continue to prepare for the possibility that the vaccine mandate will go into effect later in the week.”
Meanwhile, unvaccinated staffers must continue to submit their COVID-19 test results, Porter said.
The DOE said more than 82 percent of employees have been vaccinated.

It’s too bad this has now come down to a fight for one’s principles. It was always just a public-health decision: Do I sacrifice my comfort for the health of the community?
But no. It’s now fight to the death as if it were freedom itself.
It’s almost like some feel left out of the American Revolution. Nothing to take a life-or-death stand on anymore, so one has to be imagined.
Imagine the paperwork and cost to fire over 30,000 people. And throw their unions into the mix as well. I doubt it will happen.
How can this unapproved jab be forced on anyone?
More relevantly here, how can it be forced on anyone in a public health emergency when it is not forced on everyone. Any administrative or executive rule must be "reasonable" and not aribitrary and capricious. You cannot exclude politically favored classes or individuals.
The Community’s health is not my problem, unless I’m sick. I’m not sick.
It’s not being forced on anyone. They have a choice. That’s why I try to put “mandate” in quotes.
Nobody said it was your problem.
You had a choice, to help protect the community’s health or not to.
You have choices about a lot of things. Nobody says they’re your problem.

What unmitigated baloney!!! A lot of cases of COVID and a lot of infections of other people are coming from so-called "fully vaccinated" people.
Never mind the fact the biggest spreaders of the CCP virus are not the unvaccinated but fat people...want to get into a real discussion and compare who’s not helping “protect the community’s health” as well as costing us zillions in health costs- the fat or the unvaccinated??
I’d love to have that debate...
