Woman sues Kellogg’s, says strawberry Pop-Tarts don’t have enough berries

Now, this seems berry ridiculous.

A new lawsuit is claiming that the strawberry filling in Pop-Tarts — the sugary breakfast pastry from Kellogg’s — apparently has very few actual berries.

The food corporation is being sued in a new class-action suit, according to TMZ, over claims that they’re misleading buyers about what’s in the pastry.

Elizabeth Russett, a woman from New York, is leading the charge against the company, TMZ reported, and alleged that the fruit filling in the Whole Grain Frosted Strawberry Toaster Pastries is mostly comprised of other fruits.

The suit claims that the sweet filling of the breakfast item is filled with pears and apples more so than strawberries. Russett alleged in the suit that it’s not enough to provide the berry’s nutritional benefit and to elicit a strawberry taste.

Russett is urging Pop-Tarts to adopt more accurate labeling and claims the damages exceed $5 million, per TMZ.

I would doubt there are any berries. Why even submit yourself to this dreck?

“Elizabeth Russett, a woman from New York”

Of course. California would also have worked.

Typical Leftist response to a problem: Instead of not buying the product, sue the company and make them: 1) add more fruit, thus raising the price, or 2) withdraw the product. So typical: If a Conservative doesn’t like a TV program, they change the channel. If a Leftist doesn’t like it, make sure everyone conforms to their will by making a law that bans it. Whether it’s gays on wedding cakes or 32oz software drinks, Leftist want to take away your options...period.

Probably too lazy to work and looking for a quick payday.

The LAST place on earth I would expect to find fruit would be a Pop-Tart.

“Tart” is a synonym for prostitute. She might have better luck with her payday by going after Kelloggs on the sexism angle.

Originally, it came unfrosted, as the company believed that the frosting would melt off. But, by 1967, it was confirmed that the frosting was able to stay on the cookie as it toasted in the toaster.

You can still find strawberry and sometimes blueberry unfrosted. I prefer them that way. They are also good dunked in coffee. I make no nutritional demands of my toaster pastries. That's not what they are for.

If I want the nutritional benefits of strawberries, or if my wife wants me to have them, we make a trip to the fruit stand down the street.

Is she comprised mostly of potatoes? If not, then the case should be thrown out.

How many of you got that?

The same kind responsible for “Caution, coffee is HOT” @ McDonalds and everywhere else.
I believe the plaintiff in that case got $10 million.

There is no loss to the attorney/plaintiff in bringing a frivolous lawsuit.

I saw a few years ago that honey producers and sellers (particularly some big retailers) were sued because someone claimed their honey, which must be filtered out of the hive to remove dead bees, bee-parts, wax, etc.... meant the honey was not “NATURAL”

Cost the industry a few $million in legal fees.

If the woman is eating pop tarts, she doesn’t care much for nutrition anyway. What a corker! And you’re right, what lawyer would take up this ridiculous charge?

And I am certain the lady is traumatized, angry and confused by the lack of strawberries. There’s even a precedent for this condition; see Queeg vs. the crew of the USS Caine.
