States undoubtedly lost their positive right to admit persons as of constitutional right on January 1, 1808. IMO, they would retain a negative right to refuse admittance of non-citizens unless Congress passed a law (or the Senate OKed a treaty [applicable to say genuine refugees]) to the contrary.
Immigration is now fully subject to Congressional authority, which may not be fully exercised (I can’t say as I’m not an expert on immigration law).
How is it that a state or city can declare they are a sanctuary state or city?
