You don't fire warning shots. You shoot to stop a threat which puts you reasonably in fear of death or grave bodily harm. Since this feces-avian could not have been reasonably in fear of death or grave bodily harm, he had not justification to shoot at all.

This is basic deadly force and self defense law. Come on down to WV or VA and take a "concealed carry" class. It won't help you defend yourself in the Glorious Peoples' Democratic Republic of Maryland, but it will give you a good understanding of the law.

Where was that bullet going to go if it missed Ashli Babbitt?
