Falsifying business records “with intent to defraud,” by itself, is a mere misdemeanor under New York law. It is only elevated to a Class E felony, punishable by 1–5 years in prison, when committed with “intent to commit another crime and aid and conceal the commission thereof.” So Bragg’s challenge is to prove not only that Trump illegally concealed his hush money payments, but also that he did so in furtherance of another crime. That crime, Bragg’s announcement of the indictment confirms, is a violation of election law: Bragg argues that Trump devised this scheme with the intent to influence the 2016 election by preventing voters from learning of his affair.

The indictment does not indicate exactly how Bragg plans to connect these dots. It does suggest, however, that the district attorney will attempt to frame the payments as part of Trump’s more expansive plot to suppress negative stories that could cost him the 2016 race. If Bragg can persuade a Manhattan jury of this plot beyond a reasonable doubt—and no technical defects cause Merchan to throw out the case—he will secure a felony conviction of the ex-president.

These charges will be difficult to prove.

2016 was the 56th Presidential election, if I have counted correctly, and Donald Trump was the first candidate ever to try to keep embarrassing information out of the news. What a shocking departure from decorum.

The indictment isn’t intended to be a slam dunk, it’s meant the smear Trump during next year’s campaign season.

What will be darkly humorous is IF this thing blows up in their face the media slobs and the corruptocrats will cheer on the riots and destruction that will ensue.

The problem is the world is no longer a place that made at least some sense. The world has gone mad, and there is no law. And thus, they will likely force through a conviction regardless of the facts, and DJT will be jailed.

Which will also bring riot and destruction from the left as they celebrate that conviction.

It doesn't matter. As Alan Dershowitz says, Bragg is likely to get a conviction on one or more counts from a New York jury in a case presided over by a New York judge. Any conviction will doubtless be overturned on appeal, but this thing will drag on well into 2024 and beyond, and that's the entire point - it's an opportunity for Democrats to punish Trump for daring to win in 2016 and for daring to run again now. RINOs can be counted on to (as usual) stand around impotently, clucking their disapproval toward Trump.

Having used the full might of American intelligence agencies, the FBI, lawyers, and surrogates in the media to suppress and discredit the content of his son's laptop leading up to the 2020 election, this case must have Joe Biden shaking in his slippers. /S

Of course, you could say the same about the suppression and discrediting of Hillary's e-mails.

The Slate article says
Under New York law, it is pretty clear that Trump’s actions, as alleged, were made with “intent to defraud.” So this aspect of the charges should be a slam dunk.
but the U.S. Supreme Court has repeatedly held that in order to constitute fraud, the object of a scheme must be to deprive a victim of money or property. Who was deprived of money or property in the case? Is Bragg prosecuting Trump for defrauding himself?

The term “intent to defraud” is important.

Defraud means according to my Random House Dictionary “to deprive of a right or property by fraud”. The “de” of “defraud” matters.
