In Texas you can use deadly force to stop a theft or criminal mischief in the nighttime even if there is no threat involved if it is the only way you think you can stop it

Yeah, the DA may make this guys life difficult but he’s probably in the clear

It’s a defense of prosecution in Texas. Upu can’t even steal one dollar from a person. We gave precedents for this in Texas...even in Harris County.

You can’t chase a thief and demand or take your property back? (If the thief decides to escalate then that’s on him).

That’s what I figured... actively chasing the perp down to force a confrontation, claiming stand your ground (I thought he had a gun/felt threatened) seems an impossible argument to make.
