Councilman Mark Whitaker says he wants city leaders to consider banning racist groups from protesting in Portsmouth.
Whitaker sent an email Tuesday to City Council members, City Manager Lydia Pettis Patton and City Attorney Solomon Ashby requesting that the group discuss the issue at the Aug. 21 public work session.
The councilman said he made the request in light of the tragic events in Charlottesville and other issues across the country involving White-Supremacist, White-Nationalist, Neo-Nazi, and other hate groups with a history and pattern of perpetrating violence on citizens.
On Saturday, a white-supremacist gathering in Charlottesville turned deadly when a car plowed into a crowd of counter-protesters, killing a woman and injuring 19 others.
But restricting speech, even if it's hateful, violates the First Amendment and puts the city at legal risk, fellow Councilman Bill Moody said.
In Charlottesville, for instance, far-right protesters won a suit against city officials who tried to get the group to move its protest away from downtown, citing safety concerns and logistical issues. The American Civil Liberties Union backed the group on First Amendment grounds.
Im as upset about what happened in Charlottesville as anybody, and I detest the hate that was exhibited among the alt-left and the alt-right, but the councilmans suggestion, I dont think, would hold water with our Constitution and certainly with the First Amendment, Moody said. If we did try to do something like that, we would end up in court, end up costing the taxpayers a lot of money and end up embarrassing our city.
Should protesters descend on Portsmouth and break the law, we need to deal with it swiftly, Moody said.
You cant abolish free speech, he said. Coming up with a list to keep people out of Portsmouth is just not on sound legal ground.
So, Antifa and Black Lives Matter won’t be allowed to protest in Portsmouth?

Portsmouth, was once a beautiful, charming city in Hampton Roads. It has been transformed by ferals into an urban Russian roulette wheel. Today there are maybe 4 or 5 square blocks where it is "somewhat" safe to walk, at least before sundown. It's the same old story as hundreds of once beautiful towns and cities.
There is a riot-prone hate group that rallies and protests and burns a lot.
What is it called?
BLT?

They can try,but even racist groups are protected by the First Amendment
Which ones? Does he include BLM Nation of Islam etc?
Still no “Noble Cause” clause in the Constitution - but they want to decide what constitutes “hate” so their BLM/Anti-Fa folks have free rein to rain down physical hatred anyway, so what the heck.....
