Thank you for writing to express your concerns about the Protection of Lawful Commerce in Arms Act (S. 659). I appreciate hearing from you on this important issue.
As you may know, the United States has the highest rate of firearm related death among industrialized countries. On average, more than 32,000 Americans die each year from firearm injuries. Given the level of gun violence in our country, we must do more to protect consumers against faulty or unsafe weapons and deter the sale of firearms to criminals. Our civil law system plays a critical role in this effort, protecting citizens from gun manufacturers and sellers who fail to act with ordinary prudence and caution.
The Protection of Lawful Commerce in Arms Act (S. 659) threatens the ability of our civil courts to provide this protection. In a radical departure from long-standing liability law, the bill would grant the gun industry special legal immunity in the majority of civil suits. It would also eliminate the last defense of consumers against companies that sell weapons recklessly or refuse to market weapons with feasible safety devices. Although I support common-sense legal reform to prevent frivolous lawsuits, I oppose this bill because it goes too far to protect the gun industry at the expense of victims.
