Report: Daschle subpoenaed to testify at Janklow trial

RAPID CITY, S.D. - Sen. Tom Daschle, D-S.D., has been subpoenaed to testify in Rep. Bill Janklow's trial next week.

The subpoena comes from Janklow's attorneys, the Rapid City Journal reported Thursday, citing a Daschle spokesman who spoke on condition of anonymity.

Janklow, R-S.D., will go on trial in Flandreau on Monday in an Aug. 16 crash that killed motorcyclist Randy Scott, 55, of Hardwick, Minn. Janklow is charged with a felony count of second-degree manslaughter and misdemeanor charges of reckless driving, running a stop sign and speeding.

Moody County State's Attorney Bill Ellingson says Janklow was going 71 mph when he ran a stop sign and put the Cadillac he was driving in the path of Scott's Harley-Davidson at an intersection near Trent. Scott died at the scene. Janklow broke a bone in his right hand and suffered bleeding on the brain.

Daschle was with Janklow at an event in Aberdeen earlier that day. He will likely be asked to confirm when Janklow left that event, the spokesman told the newspaper.

If convicted of second-degree manslaughter, Janklow would face a maximum penalty of 10 years in prison and a $10,000 fine.

Cheap theatrics on the part of the Janklow defense team. They are trying to establish that Congressman Janklow left a veteran's event also attended by Sen. Daschle in Aberdeen, SD (about 175 miles from the crash site) earlier than was reported. Based on a previously reported time of departure a calculated average speed of around 80 mph would be needed to arrive at the site at the time of the crash.

When is the Republican party in SD going to wake up? Janklow is political toast and the sooner he resigns the better. Regardless of the outcome of next weeks trial he cannot be re-elected and holding on until after a trial will simply give this seat to Democratic challenger Stephanie Herseth. Holding on until the election will likely pull even more voters into Daschle's camp and give the Democrats a sweep of the SD Congressional seats. This is unexcusable in a state that voted for Bush by almost 2 to 1.

So if Daschole is asked to testify, his best response would be a deposition, unless he sees political profit in appearing at a favored Republican's demise.

Good assessment. Herseth would be worse than even Daschle. She seems like a Hillary wannabe. But I can't see that Janklow would ever resign for the good of the party or the state. It's not in his oily personality to do it. Do you think Thune would run against Janklow in a primary instead of against Daschle in a senate race? Polls have him losing against Daschle.
