On NBC Nightly News with Tom Brokaw earlier this evening, during the story about Gore's endorsement of Dean, Andrea Mitchell referred to the Supreme Court's decision "which denied Gore the Presidency."

I believe the Presidency would have been Gore's had the Florida Supreme Court's unconstitutional decision been allowed to stand.

But you are wrong.

Please explain how any action of the Florida Supreme Court could have made Gore President, given that the Florida Legislature was prepared to appoint Bush electors AND the Republicans had a majority in Congress.

How could Gore have possibly become President?

The 9th Circuit is an Article III court inferior to and under the jurisdiction of the US Supreme Court.

The Florida Supreme Court is not.

This is hilarious: W is fighting a war on terrorism, in the present, while the Dims are still whining incessantly about 2000. We need to form moveonalready.org, in a response to these people.

I agree. The whole "hate Bush" campaign rose out of a three-year old grudge. They (Dems/Libs) will certainly get the cheating/lying/stealing skills down better in the next election. It's gonna be a rough ride in '04. I don't think we have enough out-of-work people to guard the polling places full time...and they know it.

Gore tried to steal the election, and got shut down by the Federal Supreme Court.
Attempted theft is not an actual crime in the imaginary world of Democrats.
No crime is a crime, unless a court convicts you of it!
It was real close here in 2000.
But the majority held our nose and voted "R".
I dont think 2004 will be as close, and giving the Democrats another opportunity to steal an election.
We are still pretty mad down here that Gore tried to steal the position of POTUS.
But CNNABCNBDCBS is not going to report that fact.

It was my understanding that all the U.S. Supreme did was to, in effect, tell the Florida Supreme to stay out of the legislating business, by telling them they could not over rule the Florida legislature.

They did much more than that.

But even if you were right, they usurped the role of Congress in counting the electoral votes.

Under Article II, the state legislatures solely make the rules for appointing electors. Under Amendment XI, the electoral votes are counted publicly by both Houses of Congress in a special session.

It has happened before that there have been competing slates of electors from a state. This is a political question, not a judicial one. It is supposed to be resolved by Congress, not by the Supreme Court.

Congress should have and would have dealt with this matter in January, 2001.

What we don't need to forget is, that the Dims will have the media, celebrities, etc. behind them. And, let's face it, too many let those people influence them. Hopefully, not enough, but just one person is too many. No matter how good Iraq and the economy go, the above-mentioned will paint it as the worst calamity in the history of mankind. I know that a lot of people don't like some things that W has done, but they need to realize that a Dean, or a Hillary, will be many times worse. A protest vote can only help the opposition. So will staying at home.

Its called E-Q-U-A-L rights. In other words if Florida was to recount the whole state, like the democrats wanted near the end, then all states would have to be re-counted. Thats what really settled the issue and that is the real reason why it went to the US Supreme Court. It became a constitutional issue.
Aside all that. The FL supreme court defied the Florida law which said; That a hand recount was to be done only in the case of an act of god (weather) or fraud. Was there either? NOPE although it was reported the demoncrats did commit fraud in several districts, but the RNC did not care to press charges. They did commit fruad by trying to disallow the military vote.
If you remember..the Chief Justice of the FL supreme court was absolutely livid with that courts last ruling. He and one other judge KNEW they were gonna catch hell for it and they did.

You are correct. I live in Illinois and we still use the punch card, with no problems, and no chad problems either. I believe the democrats cannot read. the SC did not give Bush the presidency, They sent the matter back to the Florida supremes, and prevented them from rewriting the Florida law to fit their needs.

Depends upon which strata of democRat you're talking about. The dim congress critters understand it all, and perfectly; but those in the trenches, like the woman with the cigarette-smoke raspy voice in Florida who stated her readiness to go to jail in defiance of fair election laws, understand none of it.

Democrats have a history of illegal or questionable methods used to sway elections (Nixon 1960, Missouri 2000).

Actually, they've being doing it for over 100 years.

All persons desiring to vote the Democratic ticket are registered without personal application, and certificates are furnished them either before or on the day of election without even the formality of an oath as to eligibility. Registration the fountain-source of election, curtails Republican suffrage by the expense and inconvenience it entails upon persons not living at the county-seat, by refusal through willful neglect to register Republicans, and by fraud of the supervisor in making false entries; it adds to the Democratic vote through his fraud in unlawfully adding to the names on the registration-books those of all persons who are expected to vote the Democratic ticket....  
....At a neighboring poll another scene is enacted. The polls are open, the boxes shown, the voters deposit their ballots, there is general levity, and everything appears to be fair. There are three hundred Republican voters; the Democracy have secured forty or fifty votes, and the polls close.
