Continuation of "Falsely accused":
One of our former employee recently told us that, the claimant told her that they can make money on us and asked her to join this sexual harassment scam. She said she told her it's wrong and refused the proposition.
Anyway, we got a lawyer who worked many of these cases before.
We showed him all the paperwork and gave information such as the claimant is a habitual accuser and all the people who gave nagative coments to the investigator told lie, one way or other, which we will be able to prove.
Guess what he said!!!: Bottom line is it is not worth fighting over it. And he will help us negotiate to pay her off as less as possible.
Even though State did poor and unfair investigation and listed only rumours as facts and we may be able to prove them however he knows State will not change its position once they decided their position. It will just cost us extra money.
Also, he said State is protected and we can't sue State. On top of it, people who lied will not be sued since they did not make those statements under oath. (So it's OK to lie??)
According to this lawyer there's no win situation for us. He said small businesses are often targeted to these claims. And trying to prove we are right will just cost us more money.
I couldn't believe this!!!!! Do you? Where's justice??

i am afraid that i agreee with the advice you got in the first thread. You can not afford to not have a lawyer on this matter. Perhaps you cannot sue the state, but you can sue the plantiff in civil court. i see no other way for you to regain the good name of your business and your husband's reputation.
You should be aggressive, and non-compromising. Do not settle. Perhaps you can even recover your legal fees if the complaintant against you is found to be laible for her statements. Point being that you need a LAWYER!!!, not a bunch of amature posters from FreeRepublic giving you advice. Some of us are Lawyers, most are not, and others only think they are ;^)
i believe that the insurance company needs your permission to settle. Keep in mind that they also have an agenda...to keep their expenses as low as possible, not to work for your good. This might be the basis behind their advice. Like it or not, you need your own lawyer, and you should refer the entire issue to him/her...yeah, try for a female lawyer, it has it's benefits.
