I don't think so. I think the idea was that the law banning SSM was against the Califonia State Constitution. If you are going to challenge a State Supreme Court, the next stop is the US Supreme Court.

Can they overrule a state supreme court? It is not a federal matter is it?
BTW, I am a NYC conservative, my heart goes out to you out there in SF, you being a Republican and all. Do they make you wear a badge or something?

I really cannot see on what grounds the 9th circuit would be able to enter in to this situation. This is not a constitutional issue.
