It wasn't the CA SC, either.

That it even had to go up to the California SC to get shut down says a whole helluva lot. This whole mess should have been an open-and-shut case. Now it's turned into a massive issue of constitutional challenge that's sure to beget more judicial activism.

I don't think that if the California SC were going to follow the Massachusetts SC they would have issued a hold. It would seem to me that having more issues of fait accompli out there would give more political heft to a ruling like that.

Another thing I haven't heard anyone talk about is the currently impaneled grand jury's power to investigate any issue of law breaking brought to their attention. I understand the members of the jury can move on any matter of public offense by their own discretion.
