Manufacturer Argues Against Ephedra Ban

The manufacturer of a popular diet supplement containing ephedra urged a judge to block a nationwide ban on the herbal stimulant that was taking effect Monday, arguing that there is no proof it is dangerous if used properly.

The herbal stimulant, once hugely popular for weight loss and bodybuilding, has been linked to 155 deaths and dozens more heart attacks and strokes.

In a lawsuit filed last month, lawyers for NVE Pharmaceuticals Inc. of Newton, manufacturer of the supplement Stacker 2, asked for a temporary restraining order blocking the ban on ephedra pending further scientific tests. U.S. District Judge Joel Pisano was to hold a hearing on the request Monday morning.

After years of fighting manufacturers over ephedra's risks, the Food and Drug Administration announced in December that it was banning sales of the amphetamine-like herb — the first such ban of a dietary supplement. The ban takes effect Monday.

Research shows the herb can speed heart rate and constrict blood vessels even in seemingly healthy people, but it's particularly risky for those with heart disease or high blood pressure or who engage in strenuous exercise.

Unlike medications, which must be proven safe and effective before they're allowed to be sold, federal law allows dietary supplements to be marketed without any such proof. To curb a supplement, the law requires the FDA to show it poses a significant health threat.

NVE Pharmaceuticals maintains that the FDA lacks proof that ephedra is dangerous if used as directed, and its lawsuit argues that the agency simply reacted to the emotion of high-profile deaths like Baltimore Orioles pitcher Steve Bechler.

The FDA argued that it amassed sufficient proof of ephedra's dangers from thousands of side-effect reports and scientific studies that proved the herb's stimulant-like effects.

Ephedra sales already had plummeted because of publicity about the risks, which peaked after Bechler's ephedra-related death a year ago. Three states — New York, Illinois and California — prohibited the stimulant on their own.

I agree there should be some injunction preventing the ban. There is no real justification for it. Millions of people have used ephedra without consequense. Just because 155 people have misused it and died is no reason it should be taken off the market, out of reach of the other 279,999,845 people in America who may be responsible customers.

Your point is well taken. I, however, do agree with this ban. The extracts made from the Ephedra (Ma Huang) plant have been misapplied to the detriment of many peoples health.

When used appropriately this plant works well for many people. When extracted and reduced to the separate alkaloids this becomes something completely different. Her is where the problems have occurred.

Why should the fact that some dumbass abuses a substance make that substance unavailable to me?

Dang straight.

This kind of running-scared thinking is ludicrous and can be downright dangerous, itself.

The way our society runs scared today (ironically being spoiled as hell by all those terrible drugs), we should just take all drugs and special foods and preps off the shelves. That way we guarantee that any problems that arise are purely from the way nature intended, and not our bungling.

Ma Huang is in Ripped Fuel (Twin Labs), correct ?

I used it for about 4 years and never had any problems with. It was just a bit
expensive and so I stopped using it. I used to use it before my workouts in the
early mornings ....

I agree. If they can ban ephedra because a couple of people died out of millions of consumers, it'll be a snap to ban tobacco completely.

The people who abused epedra will just find something else to abuse.

The issue is the people, not the product. And we can't keep trying to protect people from themselves.

Next ban may be on Advil, I'm sure it's been abused. Drinking Windex would cause an adverse reaction, better ban it. Eating of paper products certainly is not healthy, no more toilet paper or napkins. Jeez, where does it end?
