John Walker Lindh mistreated?

Just as a legalistic memo defending torture was being leaked out of the Justice Department's inner sancta, the Los Angeles Times was giving all of us a peak at some of the separate but equally legalistic arguments being set forth in defense of John Walker Lindh.
    You remember Lindh, also known as Abdul Hamid when he was with the Taliban in Afghanistan, and as Suleyman al-Faris before that, when he was about to begin training with al Qaeda. How could anyone forget him?
    Lindh is now doing 20 years for supporting the enemies of the United States. But he turned up in the news again when some of his legal complaints were made public. According to this account, he was never read his Miranda rights after being captured.
    Shocking.
    After all, the only thing Lindh had done was take up arms with the Taliban and his al Qaeda buddies. And, oh yes, he'd also been caught up in a prison revolt at Mazar-i-Sharif that cost the life of the first American combat death in Afghanistan -- a CIA agent named Mike Spann. And hundreds of others.

Excuse me but he was apprehended by troops in a foreign country. He was not arrested by police in America.

He was not even known to be an American at the time and certainly the other enemy combatants who were captured were not pussyfooted as if they were mere "criminals".

"And 20 years from now — less with time off for good behavior — the usual quarters will probably hail him as a martyr when he walks out of prison still in his early 40s. Who will remember Mike Spann then? Does anyone outside his family and service buddies remember him now? We all should."

Well, take out of solitare and release him into the general prison population.

That way his body gets early release to go home to Mecca.

Two innocent men were beheaded by the terrorsts in one week, and the media can't be outraged about that because that would be "taking sides," horror of horrors. Meanwhile the media pundits are "outraged" whenever America fails to treat a terrorist like a folk hero.

If he's been mistreated, then it's clear that we are morally unfit to dispense any justice. He should be released at once. To do otherwise would be further proof that we are barbaric and criminal.

Al Zarqawi, the Iraqi head of Al Qaida, and the only major player still in the game, should be notified that we have an American prisoner for him. The dropoff should be made as soon as possible, somewhere in Fallujah.

Al Qaida knows hospitality, and they'll be eager to pick him up. I'm sure they'd love to be heading John Walker Lindh's way. Yes, sir. Be heading. John Walker Lindh.

Giving him to Al Qaida is the only fair thing to do.

Why is he even still Alive ? The rules of War call for traitors to be SHOT If were going to be held to Geneva convention rules over Abeu grebe[sp?] prison they should hold as well for traitors in our midst !

The US agents who came accross Lindh should have just told the Norther Alliance types "Nope, he's not one of ours - he's just another Pakistani Taliban member", and let the NA deal with the vermin as they wished.

That would have been appropriate. As I understand it, Lindh abandoned his US citizenship long before the War on Terror. His failure to fill out the proper paperwork to make it official did not make him a traitor. Whether he was a fool or a scumbag I can't say.

Put it this way:

Say that prior to WWII, a Japanese person went to the United States because he liked what America stood for.
Then comes the war and he serves as a translator in the conflict with Japan. Is he guilty of treason against Japan?

If as a member of the Taliban, Lindh shares guilt for any crimes, he should face the same justice as the rest of the Taliban.

This is a case of emotional politics corrupting justice. To me it's similar to the DC sniper, John Mohammed being charged with murder. At the time of Mohammeds actions, we were engaged in the War on Terror. By his own admission his target was the United States. This US citizen covertly carried out his terrorist acts as an nonuniformed enemy combatant against United States. That is treason and worth the death penalty. I don't mind seeing him punished, but as a matter of principle, for the correct crime.

Lindh certainly deserves some Afghani justice.

Since we're talking about the way things oughta be, I'd like to have seen each member of the Taliban who couldn't be charged with specific crimes have a scarlet "T" tatooed on their faces. Then any Afghan woman who sees them is allowed beat on them at will. Anyone of them who defend themselves would then be summarily executed.

That would be fitting and just.

Way better than 20 years in a Federal prison with better living conditions than 75% of the world's people enjoy.
