So McCain voted right? I had heard people saying he didn't...but it seems like he did. I know he spoke out against the amendment. Maybe he wanted to extend debate to get some face time. I don't even have to look to see what my NJ Senate delegation did.

Interesting that the 2 Ohio guys voted for cloture. I had heard they were leaning to a No vote on the FMA itself. (Which could just go to show that they believe it important to get a recorded vote on the merits, not just on cloture.)

Wow - Specter votes yea? His typical election-year appeal to the conservatives I would guess, because the other usual suspects (Snowe, Collins, Chafee) voted no.

What the heck? All this vote would have done (if accompanied by a 2/3 House vote) would be to send the issue out to states for ratification - and even then it'd take 3/4 of the states to ratify it, if I remember correctly.

No one could possibly have voted against this on the grounds that "the states should handle it." That's precisely what this process allows for.

I think this battle is worth fighting but admit it's already a lost cause. Alabama is a pretty conservative state and I don't think it would pass here.

I think it does show the typical problem, though, with a Senate majority seemingly maintained through a tiny minority of RINOs. Otherwise, it was pretty much the party-line vote.

Most states had sodomy laws, adoption laws, rules for marriage, etc. until Federal courts threw them out in violation of Amendment Ten. Perhaps an overhaul of Federal Courts and jurisdictions which can be corrected by Congress would be in order. Perhaps it should have been done decades ago. Congress would have to take a stand and rely on Constitutional procedures to do it which is rather unusual for them. There were quite a few that felt that with the record most of our politicians have in ignoring the Constitution, another amendment would probably be ignored as well.
