Kerry Not A US Citizen?

I was reading the free PDF of Chapter 8 of "Unfit for Command" offered by Human Events Online, only to be shocked to read that John Kerry was a leader in a November, 1971 vote by the Vietnam Veterans Against the War (a group with known communist ties) on whether or not to assassinate pro-war US Senators.

Now, at that time in my life, I was just learning how to tie my shoelaces, so forgive me for my historical ignorance of the period.

What is so striking though is that this well documented event, and Kerry's participation in it, seems to fit the bill as "plebiscite or act of rebellion or secession" which in the 14th Amendment disqualifies someone from running for federal office, and in the Neutrality Act of 1940, automatically strips a person of their US citizenship. If this is so, Kerry has not been a US citizen since 1971, and every vote in the House and Senate by him has been invalid. His current candidacy for President is similarly invalid since he is not a US citizen and incapable of running for federal office these two different ways. What do y'all think?

I think the headline the day after any Republicans try to make an issue out of it would read, "Kerry Surges In New Poll"

Negotiating with a foreign government also strips the person of his/her passport and possibly citizenship.

Technically, maybe so. However, his election to the U.S. Senate after those acts would be seen to effectively negate that.

Sort of like in contract law, if you affirm a debt after declaring bankruptcy, you still owe the debt. If you're elected to public office, the legal barrier has been crossed already.

If this had been brought to court and litigated against Kerry's favor during his first run for public office, it might have held. But not now.

The voting public doesn't like political games trying to disqualify people for subjective reasons, they don't like people pulling out the law book looking for dusty passages that could be applied for political gain, or throwing candidates off of ballots, or suing for partial recounts, or switching candidates at the last second, or keeping dead people on a respirator so they can get past a deadline, or waiting past deadlines to resign.

We don't need Democrat style games to beat John Kerry and they will likely have the opposite effect. We made cases like this against Clinton for a long time and it got us exactly nothing.

Tell the American voter the truth and then let them decide.

You have a point. However, being a Libertarian here in NH, where the Democrats are conspiring and sabotaging to keep LP candidate Michael Badnarik as well as Ralph Nader off the ballot, I'm thinking that a bit of turnaround is fair play...

It would be if we had the media 100% behind us like they do. If we try to throw someone off the ballot it is mean Republicans trying to deny the voter a choice. If its Democrats doing it then it is them trying to protect the validity of the electoral system.

Everyone knows its true.

Democrat controlled towns have:

a) refused to return ballot access petitions which they certified..
b) returned them after the statutory Sept 1 deadline for them to do so...
c) returned them after the Sept 8 deadline for the LPNH to turn them into the Secty of State of NH...
d) in one case, in Rochester, NH gave our certified petitions to some unidentified individual at city hall who has not been heard from...
e) with E911 renumbering/readdressing, if a petition signer put their old postal address, but the voter rolls had been updated for E911 with new street numbers or street names, that persons petition was dq'd on grounds that they were registered to vote in the town, but not at the listed address.
f) decerted petitions as 'unreadable' which are plainly written in block letters.
g) had LPNH petitioners arrested outside a post office

What was the total number of raw petitions collected for Badnarik?

At what point did the LPNH hold a press conference, or isssue a press release, to focus media attention on these acts?

Who in the LPNH was in charge of the petition drive?
