O'Reilly: Hand Over The Tapes

Loofah enthusiast says recordings will prove he was set up

OCTOBER 20--Claiming that Andrea Mackris and her lawyers have intentionally transcribed secretly recorded conversations in a "misleading manner," lawyers for Bill O'Reilly and Fox News are seeking copies of these recordings, claiming that they will back up the cable news star's contention that he was set up by his former "O'Reilly Factor" colleague. After lawyers for Fox and O'Reilly filed the below court petition, a New York judge ordered Mackis and her attorneys to appear at a hearing Friday to disclose whether such tapes exist (and why they should not be turned over to the O'Reilly camp). In an affidavit, Fox lawyer Dianne Brandi cites detailed quotations (and transcribed "um's" and "you knows") in Mackris's sex harassment complaint as evidence that the 33-year-old associate producer was rolling tape when O'Reilly delivered his steamy loofah soliloquy. Bill's not looking too good on this - especially the part where he gets off on the phone sex. It makes it difficult to sell his books...

...true. And from a recent post,...

Ad Renews Charges of Bush-Saudi Ties
"She [Vice President Dianne Brandi] also turned down the latest spot from Swift Boat Veterans for Truth because it 'accuses Kerry of treason, a crime punishable by death.'"

And from the thread under it,...

"O'Reilly states he is pro-gun control, against the death penalty, for civil unions, for gay adoption (as a last resort instead of state custody) and mindful of the environment. But when asked if he would vote for President Bush, O'Reilly left open the possibility he would vote for John Kerry."

"I've known Kerry for 25 years. He's a patriot. I'm listening to what he has to say," he tells Wallace

Beldar, at:
http://beldar.blogs.com/beldarblog/2004/10/beginning_litig.html
related that based on his experience with a client who
denied saying what was accused, creating legal grounds
to expose the evidence is crucial.

Note that the BoR hasn't actually denied saying those
things. He can be, at the same time, the innocent
victim of a set-up and blackmail, and still have said
everything that's alleged. He may not even have
violated Fox policy.

Mackris could end up in jail. This is NOT how one
pursues a harrassment case (assuming that there was
any actual harrassment here, which is far from clear).

BoR has to charge "extortion", but this looks like
blackmail, and the trouble with blackmail is that
the threatened dirt is authentic dirt.

Personally, I think he's kissing up to Kerry so he will come on the Factor. O'Reilly says Kerry promised him he would be on, but he still hasn't been on.

Kerry and Edwards will do O'Reilly and H+C during the last week (late next week) I'll bet. Both will do sanitized interviews with O'Reilly and Colmes.

No he hasn't denied anything. Should there be tapes saying exactly whats in her lawsuit BO'R is toast.

My 92 year old grandmother is in shock over the allegations. She watches him every day, has every book, the "Factor" doormat, slippers, spatula, and motorized wheelchair. She's said that if any of it is true he's a total fraud.

Oh, I entirely agree. But he can still be completely
innocent of any violations of law or Fox policy.

If revealed to be a cad and a hypocrite, chances are
his career is toast. No spin is possible.

His ratings will tank.

Despite it being "just about sex", the libs won't
support him because they think he's a conservative.

And the conservatives won't support him because
they know he's just an unprincipled opportunist
who will trash anyone for ratings (e.g. Swifties).

Tell her to take that book to the used bookstore for her nickel now. O'Righteous is playing lawyer games. "She set me up" is lawyerspeak for "I did cheat on my wife, but you can't prove I harassed you even if you use the whole tape."

It makes it difficult to sell his books...

But its a children's book! Come on the public schools already have copies of Heather Has Two Mommies and Daddy's Roommate

Why deny the children of America the right to read Bill O'Reilly's children's book.

Maybe he provides advise on how to be a model citizen, husband and father.

"Maybe he provides advise on how to be a model citizen, husband and father."

It doesn't look very good. Democrats are putting quotes from his book all over the Web. Run the keywords (with the quotes, as a phrase), "their big pecs or long" at google.com to see the following quote at various news sites and other sites.

"Here's a big word for today: dehumanization.

"That's when you go out with someone only for their appearance - their big pecs or long legs. When you are interested in someone only on the basis of physique, you're dehumanizing him or her, seeing that person only as an attractive object. If you are doing that, remember, good sex occurs between two human beings, not between two objects ...

"Are you surprised by my thoughts on the subject? Did you think that O'Reilly would tell you sex is off-limits? As you know, things are more complicated than that. But I repeat my mantra: Sex is best when you combine sensible behavior with sincere affection ...

"It is also smart to recognize that there is no area more potentially dishonest than the sexual arena.

"And if you exploit a girl, it will come back to get you."

Looks like O'Reilly nailed that one.

From page 12:

56. During the course of this conversation, Defendant BILL O’REILLY bizarrely rambled further about Al Franken: “Ailes knows very powerful people and this goes all the way to the top.” Plaintiff queried: “To the top of what?” Defendant responded: “To the top of the country. Just look who’s on the cover of his book[Bush/Cheney], they’re watching him and will be for years. [Al Franken’s] finished, and he’s going to be sorry he ever took FOX NEWS CHANNEL on.” Plaintiff found O’REILLY’s paranoid rambling both strange and alarming.

This doesn't pass the smell test.

I agree. While I am not a fan of O'Reilly, the fact of the matter is that these characterizations of him look comical -almost right out of central casting.

I cannot believe O'Reilly would put a book out for kids.

This lawsuit should not help the sale his new book.

I'm not a fan of his either but this document sounds like the makings of a made-for-tv movie.

I wouldn't bet on this. If Mackris is shown to be a stalker, to be the instigator of the phone sex, to have encouraged it and prolonged it, then the entire Murdoch empire will crucify her (as they should, IMO).

If, in fact, her tapes are viewed as "entrapment", O'Reilly will stay in place. His ratings may suffer, but Dick Morris survived his travails and, in fact, has thrived.

O'R cancelled his book tour for the kids book, which was projected to be a big Christmas seller.

He has had the nerve to plug this book on the air to mothers of 9 and 10 year-olds!

I don't think too many moms will want their boys to learn about sexual ethics from Bill O'reilly after hearing about or reading the contents of the O'Reillygate Tapes.
