Ohio Elector ineligible to vote for Kerry

Stupidity news: One of Kerry's electors in Ohio, Rep. Sherrod Brown, is a congressman. Unfortunately, the constitution forbids federal office holders from being electors. It is possible that if Kerry wins Ohio, Brown's right to cast an electoral vote will be challenged in court. Whoever picked a constitutionally ineligible elector needs to get his or her mental software ungraded to the latest release.

I didn't find anything on FR when searching. This means that if Kerry carries Ohio, he won't get all the EVs, but that other EV won't go for Bush, it'll just not be counted.

If true, and if Kerry should take Ohio, and if Kerry should need Ohio to win .... than I suspect this guy will just resign as a congressman before the electoral college convenes.

Is it too late to install a new elector in Brown's place? What is the deadline for finalizing the slate of electors?

If worse came to worse, could Brown simply resign from Congress, thereby allowing him to vote as an elector? He could always run again in the special election to "replace" himself.

I am sure it is far too late for that. Probably already had a lot of early or absentee voting for the current slate.

BTW, it shows you what kind of attitude Dems have toward the Constitution, that a congressman would not even look up the criteria for being an Elector.

True in theory. I stand corrected. Politically though, if Bush gets Ohio, his chances of clear success are pretty large.
