Sodomy laws were not unconstitutional, according to the Supreme Court in 1986, and gay marriage was not required by the constitution. The First Amendment protected political speech. States could refuse to send illegal aliens to college. International opinion wasn't part of what Supreme Court justices considered. And on and on.
As the baby boom has entered the judicial realm, their motto of "anything goes" has become the watchword of legal affairs as well as social ones. If some liberal judge doesn't like guns, the issue is not decided, whatever happened 22 years ago.
