Proposition 200 Denying Benefits to Illegal Aliens in Arizona Now Law

TUCSON - A federal judge on Wednesday lifted an order barring Proposition 200 from becoming law, clearing the way for state, county and municipal employees to immediately start reporting to immigration authorities suspected undocumented immigrants seeking public benefits.

U.S. District Judge David Bury's decision allowed Gov. Janet Napolitano to issue an executive order enacting the controversial voter-approved legislation Wednesday afternoon. The decision left some municipal officials across the Valley and state scrambling to prepare workers who will be required to ask all who apply for public welfare benefits for proof of citizenship.

Attorneys for the Mexican American Legal Defense and Educational Fund, the legal advocacy group that sued to stop the government from enforcing the initiative, plan to appeal the decision to the 9th U.S. Circuit Court of Appeals in San Francisco today or Monday. But state officials vowed that the law will go into effect and said workers will be equipped to deal with the new reporting requirements.

"Proposition 200 is now the law of Arizona," Napolitano spokeswoman Jeanine L'Ecuyer said. "And (the governor) expects that agencies will comply with the terms of 200 and any related issues."

Democrat Governor Napolitano, who oppososed this popular measure, reluctantly delclares the proposition to be Law. (Yeah!)

This law requires the "authorities" to FOLLOW THE LAW. For too long our representatives have ignored the law and the desires of the people, not only in immigration but in other cases. I am pro Mexican, pro immigration but we need to enforce the law. If more states would pass such measures then the spineless weenies in Congress would have to address the problem!

Texas Gov Perry would get reelected in a landslide if he would enforce such a law here in Texas! Or better yet extradite all illegal insurgents immediately and make it the law of the land.

I am glad it passed. But you know it seems almost absurd that such a law is necessary. Illegal is illegal and there should be no benefits for illegals. I guarantee you that a WASP like me would have to show some ID and proof of citizenship to get anything. Even legal aliens should have to work and pay taxes before being eligible for anything.

It is so dang crazy it spins my head.

I say we BILL this Attorneys for the Mexican American Legal Defense and Educational Fund, the legal advocacy group for all the welfare, medical and etc these illegals have used up since 1950. That'll shut 'em up!

You are right that YOU would have to pay or leave. The problem is that many of these programs or Gov't offices are controlled by Lib. bureaucrats who absolutely will not obey the law, who believe their personal judgment trumps the law and who support the provision of services to illegals. They continue providing services and depend on groups like the ACLU to assist them. I know this is a major problem in Ca. I'm sure that the Ariz. law will encounter this same type of passive resistance from administrators.

See, that's the whole thing. I think alot of people are not anti-immigration. They are anti-ILLEGAL immigration.

There are legal processes for coming to this country to work, study, visit, do business, etc. If we need more people to work, then we need to re examine and refine those legal processes, not turn a blind eye to daily invasion.

Yes, the processes are clunky, time consuming, and expensive. I married a foreigner and learned all about it the hard way.

But just because it's hard doesn't mean people don't have to do it. I'll never understand how the pro-illegal immigration set gets away with that.

I have been SCREAMING that point on FR for five years! And the pro-illegal immigration crowd (or at least those who turn a blind eye to it and make excuses and then call those on FR who are opposed to illegal immigration as aliens) have absolutely NO REPONSE TO THAT POINT!!! Thanks!

As much as I hate to admit it there have been times when we have needed state aid (hopefully, never again). I still remember the case worker (mexican) asking in an accusatory tone, "Is your husband white?" Apparently, me being half Mexican was fine, but *gasp* my husband (who was working) was/and is white.

What about stopping enrollment in schools for illegal alien children? What about asking for citizenship in hospital ER's? The same to get a car registration and for renting an apartment. Any landlord can see that if there's a dozen cars parked outside an apartment then he's got a bunch of illegal alien mexicans living there.

There is still a long way to go.

En un comunicado, la dependencia expuso que lo anterior se debió a que el juez federal en el distrito de Arizona, David C. Bury levantó la suspensión temporal de dicha propuesta solicitada por organizaciones hispanas. Por esta razón señaló que se reforzarán las acciones en los consulados de esa entidad del país vecino del norte para proteger a nuestros connacionales. Detalló que ya se giraron instrucciones a las representaciones consulares en Phoenix, Nogales, Tucson, Douglas y Yuma, a fin de que se refuercen las acciones para mantener debidamente informada a la comunidad mexicana sobre los alcances y naturaleza de esta reforma. Asimismo, para dar a conocer a los migrantes los derechos que en cualquier caso les asisten, además de promover un mejor entendimiento en el estado sobre la aportación de los mexicanos a la economía y sociedad de Arizona. También se instruyó a los consulados para que mantengan contacto en las autoridades correspondientes, funcionarios electos y organizaciones sociales para dar seguimiento en estricto apego al marco legal, al proceso mediante el cual las instancias judiciales correspondientes continuarán revisando el caso. La SRE indicó que promoverá por todos los medios a su alcance, y en estricto apego al marco legal, que se salvaguarden los derechos de los mexicanos que residen en ese estado.

But it is a start. It is guerilla politics from the state and local level, to throw off the yoke of the Federal Government and the current Administration who is on record of opposing any efforts to stem the tide of runaway illegal immigration. If Bush and the Congress does nothing in DC, then by golly, we people at the state level will start to take care of business, state by state and locality by locality if we have to. I call on the organizers of the Arizona effort to establish fraternal relations with other groups in other states, and begin to implement the Arizona law in other states consecutively. And make it a 2006 election issue, too, while we are at it. Force local politicians to take a clear stand, one way or another. This is great news.

The ideology of the left has caused great damage to this nation and hopefully we have the silent majority of America paying attention instead of letting laws be written under our noses. I am more optimistic then I was four years ago at the end of Slick Willies second term. Things are better than they were but a lot of work is urgently demanding our attention. Mexico has Mexico's best interests in mind, not ours. If the situation was in reverse they would be shooting us at the border.

For what it means, I believe you are right on! The forces who are opposed to this type of legislation want to portray opponents of illegal immigration as somehow non enlightened desiring to deprive hard working people from succeeding. On the contrary, most Arizonans appreciate the Hispanic immigrants among us and respect their work ethic. We just want the law enforced and not be required to absorb the costs of illegals! I personally would like to see a guest worker program. I, for one, do not believe America would be as successful if it were not for the Mexical worker.
