FORT BRAGG, N.C. -- A motions hearing started Monday in the case of Sgt. Hasan Akbar, who faces an April trial on charges of killing two officers in an attack on his own men during the opening days of the Iraq invasion. A judge ruled late last year that Akbar's statement acknowledging that he rolled grenades into tents at Camp Pennsylvania, Kuwait, will be admissible when his court-martial begins. The trial is scheduled to start April 5.
The judge excluded statements Akbar made to two sergeants who guarded him after the attack, saying Akbar had not yet been informed of his legal rights.
The April trial date represents a delay granted to defense attorneys, who say they want to gather evidence to support their argument that Akbar was insane at the time of the March 2003 attack, which came just days into the Iraq war.
Akbar is accused of stealing grenades from a Humvee and rolling them into the tent of fellow members of the 101st Airborne Division. Killed were Army Capt. Christopher Seifert, 27, and Air Force Maj. Gregory Stone, 40. Another 14 soldiers were injured.

FORT BRAGG, N.C. - An Army sergeant facing a court-martial on charges alleging he killed two officers in a grenade attack in Kuwait needs further treatment for a sleep disorder, his lawyers told a judge Monday.
Sgt. Hasan Akbar fell asleep during pretrial hearings last year and a judge ordered treatment for his sleep apnea condition, but his lawyer, Maj. David Coombs, said Akbar still has problems staying awake.
Coombs asked the judge, Col. Stephen Henley, to order a break after each witness and to allow coffee at the defense table once Akbar's trial begins in April.

I know how to fix the disorder...it is called execution.
This is a joke... right?
My problem is that he is not permanently asleep.
Guilty. Wall. Read, aim, fire! That works for me.
The BOR is not something to hide behind. It is what seperates our country from every other country on earth and protects us all from a tyrannical government.

Try stripping him naked and placing him in a concrete bunker. Hand him a grenade and then pull the pin. If he falls asleep he will blow up like the folks he assasinated. Or, he will stay awake and be miraculously cured of his sleep disorder.
He is a U.S. citizen and entitled to all the protections of the BOR. Give him a fair trial and then take him out, strap him to a cot, and roll a couple of grenades under it.
I am convinced that "Miranda" was established solely to protect guilty criminals with big mouths. I really despise our system of justice.
Let him sleep forever.

If I recall, the two NCO's were guarding him (as well as protecting him) and did not question him, alledgedly did not even speak to him.
Any statement made spontaneously is admissable, other than hearsay, regardless of whether one has been advised of their rights.
Or has the liberal, warm-and-fuzzies, birkenstock-wearers been able to influence the content of the Uniform Code of Military Justice.
And, lest we forget, this puke is subject to the UCMJ, not civilian law, regardless what his name is and CAIR be damned.
