Actually I think he will be able to replace a conservative with a conservative... It's going to be the replacement of a liberal that will be the fight of his life.

Kill the filibuster now - get it out of the way. We don't want to have to fight over Senate rules AND a Court nominee.

I wonder if W will appoint one conservative to the bench after he elevates either Scalia or Thomas (ensuring two battles) or if he will just appoint one conservative to the bench as CJ and have only a single battle.

I see Scalia taking Rehnquist's job and I think the associate position is definitely Ted Olsen's if he wants it.

I thought that Alberto Gonzales was probably going to be the next justice; however, his nomination for AG (after it was quite clear that Rehnquist would be leaving very soon), leads me to believe that he either doesn't want it or Bush already had someone else in mind.
