In Colorado a few years back an amendment to the Colorado Constitution was thrown out by a judge after it was approved by vote - guess what it was about?

Yep! Limiting gay special rights. We are now a lawless society.

Yep! Limiting gay special rights. We are now a lawless society.

That's not exactly what happened. It was the U.S. Supreme Court that ruled the Colorado amendment violated equal protection clause of the 14th Amendment to the U.S. Constitution and thus was invalid. The case was Romer v. Evans. Here's a link.

They actually can do that as long as they claim it violates the federal constitution in some way. Suppose a state passes a referendum and amends the state constitution to allow slavery, or confiscation of your firearms, or changing the governorship into a dukedom and making it a hereditory office, or making Islam the state religion -- then would you complain that the judge found the amendment to the state constitution unconstitutional (under the federal constitution)?

Actually, it was our Blue State SCOTUS that told the people of CO to go take a hike. Just like they told the people of TX to go take a hike on sodomy laws. And this year they told the people in 13 states to go take a hike on executing juveniles.
