Mr. Churchill is twisting the heritage law to his own ends. The law concerning how a Native American self-certifies himself, was instituted to assist authentic Native Americans who may not have had a paper trail authenticating their geneology.

This is similar to the Social Security Administration accepting a written record in a family Bible in lieu of a birth certificate. If a person was never issued a birth certificate, a notation in the family Bible, such as "John, born May 17, 1921" is accepted by SSA as proof of birth.

He obtained his position by claiming to be a Native American; granted this should have been investigated BEFORE hiring; but it is not unconstitutional.

I was thinking those words long before they ever wrote them so they're the ones who should be charged with palagerism! (and I'm an Indian too!)

Since Mr Churchills pedigree was a major part of the basis for his hiring it is germaine to the discussion.

He lied about being an authentic American Indian.

He plagarized several academic works. That he did so is apparent when your read the works he copied or see the art he copied.

The wheels must grind slow and fine in order to fire a tenured professor.

He will be fired before the next school year starts.

But ok...when I was 10 I told everyone I was an alien from outer space! And my mom said come on, alien, sit down and eat...
So I self identified and had community acceptance...therefore, I am an alien from space.

Who knew?

I have one basic question: Did he write these things, say these things as an employee of the university? If so, I don't think the 1st Amendment applies at all. IIRC, the byline of the essay included something like "Ward Churchill is professor of American Indian Studies at UC Boulder," so I would think he was doing it as a public employee.
