And the next question is...

If the town of Weare allows it and if Souter fights it all the way to the Supreme Court, will he recuse himself? what if he does and a 4 to 4 tie occurs?

The lower court's ruling is upheld. My understanding is that SCOTUS doesn't hear cases of original jurisdiction any more. (But if they did, what would happen if there were no lower court ruling?)

I believe he then LOSES his house, as the current opinion of the Supreme Court is that this is allowed, and they'd need a 5-4 (or other majority) to overturn.

We can get the bulldozers in there much faster than even Souter can file an appeal.

Hopefully there are some Souter family graves on the site so they may be appropriately desecrated.
