There's something else worth noting when looking at the Pentagon's role in this (and other) matters. Before Jamie Gorelick even joined the Clinton Justice Department, she also served as one of the chief counsels for the Department of Defense.
Not only did Gorelick have tremendous influence in the creation of the Justice Departments "wall" in the mid 90s...but her position in the Pentagon allowed her to create a bureaucracy that gave lawyers a greater say over military matters.
This became evident throughout the 1990's when several "operations" aimed at killing UBL were countermanded. One, in particular that comes to mind, was when our drones sited Bin Laden and the mission was called off.
From what I recall, she was also part of the negotiations to extradite UBL from Sudan; but that didn't happen because these "lawyers" couldn't justify a reason for his indictment.
It would appear to me that Gorelick is personally responsible for so many of the problems (restrictions) that the Clinton administration had when dealing with terrorism...including the failure to even profile the most dangerous of terrorists in this country. Yet, she sat there on the 9/11 Commission in judgment of others, when she was perhaps the most guilty.
And Gorelick isn't the only person on the commission with some ties that look pretty hinky.

Not only sat on the commission, but was "tasked" by the perfumed-prince former senators and governor with deciding which papers and persons would be brought before the committee.
I saw one of them on a TV interview say how fortunate the committee was to have someone like Jamie with so much "background" in the events that the commission was going to study.
