Major battle unlikely from Democrats on Roberts

WASHINGTON -- Democrats have decided that unless there is an unexpected development in the weeks ahead, they will not launch a major fight to block the Supreme Court nomination of John G. Roberts Jr., according to legislators, Senate aides, and party strategists.
.... (There is) no evidence that most Democratic senators are prepared to expend political capital in what is seen as a likely futile effort to derail Roberts.
(Democrats) have concluded that he is likely to get at least 70 votes -- enough to overrule parliamentary tactics such as a filibuster that could block the nominee.
... For now, the aide said, Democratic strategy is to make it clear Roberts was subject to fair scrutiny while avoiding a pointless conflagration that could backfire on the party.

The Dems HAVE to do their best to nix Roberts... it's the will of their base. As far as this fight goes... they haven't really entered the ring.
First of, all, the vote was 96-3.
And what does the fact that 42 of them were Republican votes show?
Surely there were more than 42 Republican votes for Ginsburg, being the majority in Senate.
The Senate in 1993 had 56 Democrats and 44 Republicans.

No. The RATS will not fight against him because they are saving it for the next battle. If they fight Roberts now and the Pubs go nuclear, the Rheinquist nomination becomes a moot point.
More than likely Scalia will be chief justice and IMHO I believe Bush will nominate Brown to SCOTUS.
Roberts ins,'t a RINO. Everything so far points to his following the Constitution and not creating law from the bench. That is what we want. For all I care, he can be a lifetime member of the ACLU as long as he is a Constitutionalist.
The question is: Will he vote to hold Roe v Wade? Scalia and Thomas will not. I don't care if he is business conservative. Our fundamental values are at stake!

You don't KNOW what his position is on abortion and such!
What you do (should) know is that he's a strict constructionist (won't legislate from the bench).
That is what has brought us rulings like R. vs. Wade.
I suppose you believe we should wait until a nominee declares he will overturn R vs. Wade, we shouldn't support him?
The sooner Robert's is confirmed the sooner Rhenquist will retire and we can start all over again.
Once Roberts got at least 5-10 Dems to say 'aye' it was all over...
Roberts already has the GOP side locked up.
IMO he is waiting to swear in his former law clerk.....a pass the baton moment for both. Then he will offer his letter of resignation.
I said he'd get at least 70 votes shortly after his nomination was announced last month. Way ahead of the slowpoke idiots at the Globe.

Finally!! someone has hit the mark. Roberts is not a RINO but Bush picked someone with a paper trail that is hard to critize. I really get upset with all you dumbniks who say that Roberts is not pro-life. He and his wife adopted two children. Proaborts don't do that.
