Robert Novak reports Senate Minority Leader Harry Reid (D-NV) "has informed" Majority Leader Bill Frist (R-TN) "that Federal Appeals Court Judge Priscilla Owen will be filibustered if President Bush names her to replace Justice Sandra Day O'Connor on the Supreme Court.
"Republican senators are divided on whether former Texas Supreme Court Justice Owen is vulnerable because she underwent a filibuster for the appellate seat and was confirmed under the compromise agreement. Frist is known to believe Owen can be confirmed in the face of a filibuster.
"Republican Senate strategists believe Attorney General Alberto Gonzales is the only possible Bush nominee to replace O'Connor who would not face a filibuster."
The AP says President Bush "extended invitations Friday to key Senate leaders to meet at the White House next week to discuss" the O'Connor's spot on the bench.

But, save from being limited to a wheelchair, Abbott is a fully-functioning person. He has travelled statewide campaigning for public office. He does not have brain damage or any other infirmity. He has already been on a state Supreme Court and being on SCOTUS is not a physically taxing job. Heck, we have had octogenarians on the bench in all sorts of levels of health. If the Court hasn't been modified for wheelchair access then they are in violation of their own federal law (ADA).
You are right that the Dems are champions of the double-standard but I would think they wouldn't want to touch his disability as an issue. Unlike FDR and JFK where the press hid serious health issues, they can't hide this - not without the elephant in the room becoming obvious. The media would not ignore it - especially if Bush trots him out for the big introduction the way he did for John Roberts. So if the Dems go into their typical baseless hysteria, it will be seen to many as if they are attacking a man in a wheelchair.
Some of the Dem-friendly media may try to keep that appearance away using tricky camera angles but it will be difficult to hide, especially if Bush introduces him as the first handicapped American nominated for the Supreme Court.

You're right that the President should nominate a Constitutionalist conservative. But he needs to nominate a Constitutionalist conservative who has no paper trail on controversial issues.

Do the Dems want Bush to nominate another woman for SCOTUS or not? It shouldn't matter what her beliefs are, she's a woman, surely NOW should be supportive....
So make them filibuster her already. These are the pro-Hillary folks who, three years hence, will be sneering that the Republicans are "afraid of strong women." Let them explain that one away.
